Data Breach Suit Against Ledger, Shopify Revived on Appeal
Ledger SAS must face a proposed class action alleging it negligently failed to protect the personal information of buyers of hardware wallets for cryptocurrency assets that was exposed in a data breach affecting 270,000 people, the Ninth Circuit said.
A district court dismissed the lawsuit for lack of personal jurisdiction, but the dismissal was improper because Ledger's contacts with California were sufficient to establish jurisdiction under the "purposeful availment framework," the US Court of Appeals for the Ninth Circuit said Thursday.
